CURATED JOURNEYS TERMS & CONDITIONS
SECTION 1: SCOPE OF PROGRAM
It is understood that subject to the terms and conditions of this Agreement, Hope African Adventures shall execute the following details involved in the fulfillment of Client’s program:
PROGRAM MANAGEMENT SERVICES
Hope African Adventures will arrange the program to include the following services, described in Client’s itinerary attached hereto as the Appendix. Such program includes, as applicable and to the extent as listed in the Appendix: commercial international/regional/domestic air tickets, scheduled/private air charters, scheduled/private vehicle transfers, accommodations (hotels/resorts/guesthouses/safari camps & lodges), food and beverage, bed/conservation/tourism levies, park/entrance/gate/vehicle fees, day tours/excursions/activities, private guiding and pilot fees, and any and all third-party services that may be requested by Client.
The above services do not include, without limitation: passport acquisition/renewals/changes, visa applications/submissions/tracking, excess and overweight baggage/equipment charges, travel and/or medical insurance, vaccinations/immunizations, premium wines/spirits/champagnes, any items of a personal nature as stipulated by the accommodation facilities, or gratuities unless specifically set forth in the Appendix.
PRICE FLUCTUATIONS
All rates are subject to change without prior warning. It is understood that any increases in rates, including, but not limited to, such increases related to third-party suppliers and providers, bed/conservation/tourism levies, park/entrance/gate/vehicle fees, fuel, relevant taxes (value added tax VAT/government sales tax GST), currency fluctuations, or any other circumstances, are beyond Hope African Adventures’ control. All services are subject to availability at the time of booking.
PAYMENT METHODS
The amount quoted for the program reflects a cash discount, and by paying via certain methods this is upheld. For USA residents, this means payment being made by QuickPay from JPMorgan Chase Bank, N.A. bank account, Zelle, Venmo or check. For international residents, this means payment being made by a forex service from overseas bank account.
If Client elects to pay by any other method, this discount will be rescinded, and additional fees will be incurred. This means payment being made by credit card or wire transfer from non-JPMorgan Chase Bank, N.A. or overseas bank account. We do not accept debit card payments.
PAYMENT PROCEDURES & SCHEDULES
Deposits and final remaining payments are due upon receipt of the invoice. Invoices are generally submitted to Client on two occasions, once at booking confirmation and second at final payment. While Hope African Adventures does its best to standardize the payment procedure and schedule, there may be instances with specific reference to third-party suppliers and providers where it may be necessary to adjust the terms and due dates, of which Client would be notified in writing.
The payment schedule is as follows:
- At time of booking: 25% land deposit + 100% airfare
- 60 calendar days prior to departure: 75% land balance + any add-on amounts
Hope African Adventures is open to discussing alternative payment plan options on a case-by-case basis with Client.
PAYMENT SECURITY
Hope African Adventures understands tours to Africa are an expensive holiday, so we have two second holding bank accounts (one for USD and second for ZAR) for deposits and final balance payments due to third-party suppliers and providers. This transparency presents a clear deviation between day-to-day operations and Client’s investment.
CANCELLATION PROCEDURES & SCHEDULES
Client agrees that if Client cancels the program for any reason, Hope African Adventures and our third-party suppliers and providers will suffer damages as a result of non-refundable payments.
In the event that one or more guests cancels the program for any reason, such cancellation must be made in writing. Hope African Adventures will not consider a notice of cancellation valid and will not release bookings held with third-party suppliers and providers until written acknowledgement by Hope African Adventures confirming the written notice of cancellation from Client and payment of the liquidated damages described below are received. Accordingly, any delay in providing written notice of cancellation or in making payment of liquidated damages or other amounts due may result in higher damages or other amounts owed.
Payments made by Client cannot be returned to Client based on the cancellation policies of our third-party suppliers and providers and our commission lines earned for all work completed to date to prepare and execute the program management services. In the event Client cancels, in whole or in part, for any reason, Client shall pay, as liquidated damages, and not as a penalty, the applicable amounts set forth in the table below. Please note that cancellation fees are only levied when Client or guest(s) cancels a confirmed program. The liquidated damages incurred escalate the closer the date of the cancellation by Client or guest(s) to their confirmed departure date.
The cancellation fee schedule is as follows:
- More than 60 calendar days prior to departure: 25% land deposit + airline cancellation fees
- 60 to 30 calendar days prior to departure: 75% land balance + airline cancellation fees
- Between 29 calendar days and date of departure 100% total program price
If the 25% land balance has been paid and the program is subsequently cancelled due to a failure to pay the remaining balance due, this specified amount will be forfeited.
Should a guest fail to arrive or any cancellations are made after the departure date (including, but not limited to, as a result of ill health or injury), Hope African Adventures will be entitled to treat the program as cancelled without giving notice and 100% of total program price shall be forfeited as a cancellation fee. Client shall also be responsible for payment of any repatriation, administrative and any other fees, charges or other amounts incurred as a result of such cancellation or failure to arrive.
CANCELLATION CONCESSIONS
Our third-party suppliers’ and providers’ terms and conditions relating to cancellations and changes vary across all the different African destinations. On a case-by-case basis based on Client’s specific itinerary, Hope African Adventures will try to assist you to recoup as much funds as possible where we can from the relevant third-party suppliers and providers or if necessary look into deferment of travel to new dates in the future. With that being said, this is not a guarantee of any refunds or successful rebooking and the result in any particular case will be dependent upon the reasoning and nature of the cancellation and the policies, procedures, requirements and constraints of our third-party suppliers and providers.
SPECIAL REQUESTS/CHANGES TO BOOKING
Hope African Adventures welcomes and is pleased to try and fulfill any “special requests” or changes that would help improve the overall quality of Client’s program. These are additional requests that are made after the final trip total has been established or during the course of Client’s program. Hope African Adventures will only be able to attempt to honor these requests if they are made in writing by Client. Once payments have been made, any additional costs or expenses incurred as a result of such request are the sole responsibility of Client, including, but not limited to, any change or refund penalties.
Changes to a booking within two (2) weeks prior to travel or during the tour will incur the following additional transaction charges:
- Domestic (Within Africa Destination Country) = USD $50.00 Per Booking Change Per Guest
- Regional (Between Africa Destination Countries) = USD $75.00 Per Booking Change Per Guest
- International (Between Africa Destination & Home Countries) = USD $100.00 Per Booking Change Per Guest
Airline costs for changes depend on availability at the time of the change. Airline change and cancellation fees, whether non-refundable or refundable, apply to that specific fare/package price.
Notwithstanding the foregoing, Hope African Adventures reserves the right to make changes to services rendered as it may deem necessary due to changing conditions. Conditions that may result in such a change include, but are not limited to, seasonal rainfall, game migrations from one region to another or accommodation/transport/tour/excursion/activity booking issues. In such event, Hope African Adventures shall use commercially reasonable efforts to substitute services of similar price and quality.
SECTION 2: TERMS & CONDITIONS
FORCE MAJEURE
Hope African Adventures assumes no responsibility for and will not be liable or responsible for any loss, damage, liability, obligation, costs, expenses, or claims, or any failure to perform hereunder, due to or resulting from force majeure or other causes or contingencies beyond Hope African Adventures’ immediate and direct control or from the acts or omissions of any party not under our immediate and direct control, including, but not limited to, common carrier delays or changes, weather conditions or hazards, flood, high water, tempest, forceful wind, fire, explosion, sabotage, insurrection, accidents, strikes, labor disputes or shortages, riots, civil disturbances, requisition, war or threat of war declared or undeclared, acts of terrorism, unsafe conditions, epidemics, pandemics, quarantines, health hazards, sicknesses, illnesses, injuries, deaths, the suitability for a disabled person of any portion of any trip, defects in machinery or vehicles, wildlife, acts of God or public enemies, or governmental actions, orders, directives, laws, ordinances, rules or regulations, whether valid or invalid, or other untoward occurrences. Client and guest(s) expressly assume all of these risks and dangers and hereby expressly agree to forever release, discharge and hold Hope African Adventures and our officers, managers, employees, affiliated companies, associates and agents harmless against any and all liability, actions, causes of action, suits, claims, and demands of any and every kind and nature whatsoever which you now have or which may hereafter arise out of or in connection with these risks and dangers.
LIABILITY
As agency of record for Client’s program, we only act as an agent for third-party suppliers and providers and other companies and persons (which may or may not include, without limitation, call centers, data processing centers, banks, warehouses, manufacturers, airlines, transportation companies, accommodation and other relevant third-party suppliers and providers). Hope African Adventures will not be liable or responsible for any changes, inconveniences, cancellations, failures to adhere to schedules, provide services or refunds, financial default, failure to honor future trip credits, negligence, accidents, losses, damages, costs, expenses, liabilities, obligations, defaults, acts, delays, defects, irregularities, or other acts or omissions of any of such third-party suppliers and providers, companies or persons or their respective employees, agents, representatives or contractors. We have no special knowledge regarding the financial condition of any third-party supplier or provider and no liability for recommending a trip credit in lieu of a refund.
COMPANY INSURANCE
Hope African Adventures has USA Travel Agents and Tour Operators Professional Liability Insurance through Berkshire Hathaway Global Insurance Services, LLC.
TRAVEL DOCUMENTATION
It is the responsibility of each guest in Client’s program to obtain and carry a valid passport, visa(s) and all other documents required by applicable law and regulations for travel through and to the countries included in the program. Hope African Adventures is not responsible or liable for any such documentation not held by Client or any guest(s) participating in the program.
TRAVEL AND/OR MEDICAL INSURANCE
It is a condition of travel with Hope African Adventures that each guest in Client’s program must purchase the appropriate travel and/or medical insurance. Client and each guest that fails or otherwise elects not to purchase such insurance agrees to indemnify and hold Hope African Adventures harmless from any claims related to their program. Hope African Adventures can assist Client with obtaining access to information concerning travel and/or medical insurance and securing the proper coverage through our preferred suppliers to protect Client’s investment and guest(s) during the duration of the program.
HEALTH & SAFETY REQUIREMENTS
Each guest is responsible for having the proper vaccinations/immunizations and required documentation of such vaccinations/immunizations before travel, and to make the necessary accommodations for security rules/regulations imposed by the relevant governmental authorities. Malaria, yellow fever, typhoid virus, ebola and other diseases are endemic to regions of Africa and precautions must be taken. It is recommended Client and guest(s) contact their local physician or health department for the most current recommendations regarding travel health and safety. Hope African Adventures assumes no responsibility for the accuracy of health, vaccinations/immunizations and/or documentation requirements prior to departure, during the program, or upon landing at the final destination.
Client and guest(s) must be in good physical and mental health. Any physical condition, diet or treatment requiring special attention must be reported in writing to Hope African Adventures when the booking is confirmed. It is the responsibility of each guest to seek and take all appropriate medical advice relevant to his or her health prior to departure and to confirm whether he or she is sufficiently fit and able to undertake the program booked.
In the event a guest becomes sufficiently incapacitated during the program and is unable to direct his or her own care, there is no one on the trip who can direct such guest’s care, and Hope African Adventures is unable to contact such guest’s emergency contact, such guest authorizes any medical treatment deemed necessary in the event of any injury or illness. Client agrees to pay all costs of rescue, medical and repatriation services as may be incurred and/or not covered by travel and/or medical insurance.
Client and guest(s) must be aware that the program can bring you into close contact with wild animals. Attacks by wild animals are rare but Hope African Adventures cannot guarantee guests will not have an incident. By accepting the program, Client and guest(s) are assuming the risk associated with viewing wild animals.
AIR WEIGHT ALLOWANCES
Client and guest(s) are solely and fully responsible for ensuring they are in full compliance with the requirements of the airlines flown. Any guest weighing more than 225 pounds (102 kilograms) must advise Hope African Adventures in advance, as an extra seat may have to be added into the pricing at the airline’s discretion for safety reasons.
- For commercial international flights to and from Africa and commercial regional/domestic flights in Africa, guest(s) must check each airline’s website in advance regarding rules and regulations for carry-on and checked baggage.
- For charter regional/domestic flights in Africa, guest(s) must comply with strict standards or incur additional baggage fees. It is recommended guest(s) carry a medium-sized soft luggage (preferably no wheels) or duffel bag when flying in small light aircrafts.
- For private charter regional/domestic flights in Africa, guest(s) are allotted flexible baggage requirements depending on the total number of guest(s), which will be discussed and confirmed in writing with Hope African Adventures prior to departure.
TRAVELING WITH MINORS
Any person under the age of 18 at the start of Client’s program must be accompanied by a parent/legal guardian. Minor(s) traveling with adults who are not the parent/legal guardian are required to present the minor’s valid passport, applicable visa, certified copy of the minor’s birth certificate and an original notarized letter signed by at least one of the minor’s parents/legal guardians. The notarized letter must authorize the traveling adult to take the minor(s) on the specified program and must authorize the traveling adult to supervise the minor(s) and permit any medical treatment that must be administered to the minor(s) under the opinion of the treating doctor. If such evidence is not produced, the minor(s) concerned will not be permitted to undertake the program.
GOVERNING LAW AND VENUE
For Client that is a USA resident, this Agreement will be governed by and construed in accordance with the laws of the State of Texas without regard to any conflict of laws rule or principle. Any legal proceeding brought in connection with disputes relating to or arising out of this Agreement will be filed and heard in Harris County, Texas, and each party waives any objection that it might raise to such venue and any right it may have to claim that such venue is inconvenient.
For Client that is an international resident, this Agreement will be governed by and construed in accordance with English law without regard to any conflict of laws, rule or principle.
MISCELLANEOUS
This Agreement may be executed in two (2) or more counterparts, all of which shall be considered one and the same agreement, it being understood that the parties need not sign the same counterpart. Signatures to this Agreement transmitted by facsimile transmission, by electronic mail in “portable document format” (“.pdf”) form, or by any other electronic means intended to preserve the original graphic and pictorial appearance of a document, will have the same effect as physical delivery of the paper document bearing the original signature. The invalidity or unenforceability of any provision of this Agreement shall not affect the validity or enforceability of any other provision of this Letter of Agreement, which shall remain in full force and effect. This Agreement will be binding on and inure to the benefit of the parties and their respective heirs, executors, administrators, legal representatives, successors and permitted assigns. This Agreement constitutes the entire agreement of the parties with regard to the matters referred to herein, and supersedes all prior oral and written agreements, if any, of the parties in respect hereto. This Agreement may not be modified or amended except by written agreement executed by all of the parties hereto. The captions inserted in this Agreement are for convenience only and in no way define, limit, or otherwise describe the scope or intent of this Agreement, or any provision hereof, or in any way affect the interpretation of this Agreement.
AGREEMENT AND UNDERSTANDING/NOTICE OF CONFIDENTIALITY:
It is mutually understood and agreed that the above terms will only become effective with the return of this Agreement, signed by Client, and the contents of this Agreement are solely for Hope African Adventures. The information contained in this Agreement is confidential and cannot be shared with or provided to any other company(s) or third-party supplier(s) or providers(s) that are or would be in direct competition with Hope African Adventures for this or any other type of program, event, travel incentive or other type of promotion. All of the above meets with our approval, and Hope African Adventures considers this Agreement to be definite and confirmed upon the return of this Agreement signed by Client within the time specified above.
THIS IS A HEADING 4 AND IS USED TO SEPARATE SECTIONS
1) Nature of Relationship
Hope African Adventures acts solely as a promoter and introducer of select travel retreats, spiritual journeys, wellness experiences, and nature-based expeditions curated by trusted third-party partners.
Hope African Adventures:
- Does not operate, organize, or manage the Soulful Travel Adventures themselves.
- Does not act as an agent or intermediary in the booking process.
- Is not a party to the contractual relationship between the Client and the third-party provider.
All bookings, payments, confirmations, travel details, terms of service, and liability will be handled directly between the Client and the partner organization.
2) Responsibility & Liability
Hope African Adventures assumes no responsibility or liability for:
- The accuracy or completeness of the information provided by the third-party provider.
- Any changes to the itinerary, pricing, accommodations, or activities made by the third-party provider.
- Any cancellations, rescheduling, or dissatisfaction experienced by the Client in relation to the program.
- Injury, loss, damages, or any unforeseen circumstances occurring during or after the travel experience.
Client is encouraged to conduct their own due diligence, read the full terms and policies of the third-party provider, and ask any relevant questions before booking.
3) Promotional Materials & Referrals
All promotional materials, links, and referrals shared by Hope African Adventures are offered in good faith and are based on trusted relationships and professional integrity. However, Hope African Adventures does not guarantee or warrant any specific outcome, transformation, or experience, as these are deeply personal and subjective in nature.
4) Payments & Fees
Client makes all payments directly to the third-party provider and are subject to the provider’s pricing structure, payment terms, refund policy, and cancellation conditions. Hope African Adventures does not receive or hold any funds on behalf of the Client or the provider.
In some cases, Hope African Adventures may receive a referral commission or affiliate compensation from the provider at no additional cost to the Client.
5) Travel Insurance & Personal Responsibility
Hope African Adventures strongly recommends that all Client purchases comprehensive travel insurance that includes coverage for cancellations, medical emergencies, travel delays, and other unforeseen events.
The Client accepts full responsibility for ensuring they are medically, physically, and emotionally prepared for the journey and that they comply with all travel requirements (e.g., visas, vaccinations, etc.).
6) Use of Personal Data
Any personal information shared with Hope African Adventures in the context of a referral will be handled with care and only shared with the relevant provider for the purposes of facilitating an introduction. By engaging with a referred program, the Client consents to such data sharing.
7) Modifications to Terms
Hope African Adventures reserves the right to update or modify these Terms at any time without prior notice. Continued engagement with any affiliate promotion or referral constitutes acceptance of the revised Terms.
8) Governing Law & Venue
For Client that is a USA resident, this Agreement will be governed by and construed in accordance with the laws of the State of Texas without regard to any conflict of laws rule or principle. Any legal proceeding brought in connection with disputes relating to or arising out of this Agreement will be filed and heard in Harris County, Texas, and each party waives any objection that it might raise to such venue and any right it may have to claim that such venue is inconvenient.
For Client that is an international resident, this Agreement will be governed by and construed in accordance with English law without regard to any conflict of laws, rule or principle.
THIS IS A HEADING 4 AND IS USED TO SEPARATE SECTIONS
1) Purpose of the Consultation
The Consultation is intended to offer:
- Professional insight into the Client's existing travel ideas or plans.
- Honest feedback on quotes or proposals received elsewhere.
- Expert direction to align travel choices with the Client’s vision, values, and goals.
The Consultation is not a commitment to design or book a trip unless agreed upon in a separate arrangement.
2) Booking & Payment
- The Consultation is charged at USD $100.00 for two hours.
- Full payment is required at the time of booking to confirm the session.
- Payments are non-refundable, though rescheduling may be accommodated (see Section 5).
3) Pre-Session Preparation
To make the most of our time together, the Client agrees to submit relevant background information prior to the session, including:
- Where they are in their planning process.
- Any quotes, sample itineraries, or inspiration they’ve gathered.
- Specific questions, challenges, or areas of uncertainty.
This information must be received at least 72 hours before the session to allow for meaningful preparation.
4) Scope of Service
Hope African Adventures will provide professional guidance based on:
- Current knowledge of the African travel landscape.
- First-hand experience and trusted supplier relationships.
- A deep understanding of soulful, intentional travel.
However, the Consultation does not include itinerary design, booking services, or ongoing planning support unless this is clearly outlined and agreed upon in a separate engagement.
5) Rescheduling & Cancellations
- Client may request to reschedule with at least 24 hours’ notice.
- Missed appointments or cancellations made with less than 24 hours’ notice are non-refundable.
- Hope African Adventures reserves the right to reschedule if unforeseen circumstances arise.
6) Limitations of Liability
While every effort will be made to provide accurate, relevant, and up-to-date advice, the Client acknowledges that:
- Final decisions and travel arrangements remain their responsibility.
- Hope African Adventures is not liable for outcomes resulting from the Client’s use (or non-use) of the advice provided.
- No guarantees are made regarding availability, pricing, or third-party services discussed during the Consultation.
7) Follow-Up Support
This service is designed as a stand-alone session. Any additional assistance — such as detailed itinerary development or travel booking — must be arranged through a separate service agreement.
8) Modifications to Terms
Hope African Adventures reserves the right to update or modify these Terms at any time without prior notice.
9) Governing Law & Venue
For Client that is a USA resident, this Agreement will be governed by and construed in accordance with the laws of the State of Texas without regard to any conflict of laws rule or principle. Any legal proceeding brought in connection with disputes relating to or arising out of this Agreement will be filed and heard in Harris County, Texas, and each party waives any objection that it might raise to such venue and any right it may have to claim that such venue is inconvenient.
For Client that is an international resident, this Agreement will be governed by and construed in accordance with English law without regard to any conflict of laws, rule or principle.
